Welcome to Fistpump! This Terms of Service governs your use of the Fistpump app and the fistpump.co website (collectively “the Platform”). By using the Platform, you agree to these Terms. If you do not agree, please discontinue use.

1. Creating a Fistpump Account

To use the Platform, you must create an account using your common name within your organization. If creating an account for a business, you confirm you are authorized to do so. You must be at least 18 years old to create an account; the Platform is not intended for children under 13. If we discover that you are under 13, we will deactivate your account.

2. User Accounts

Admin User Accounts

The initial user who creates an organization is considered an Admin. Admins can create groups, add members, and view reports of user activity. Admins should not rely on Fistpump as a substitute for official attendance or communication services. If an Admin abandons an organization, Fistpump may reassign Admin permissions to another user.

Non-Admin User Accounts

Non-Admin users can be invited by any member of their organization and may share messages, images, audio, and video with other members.

3. Your Content

You retain ownership of any content you share on the Platform. By posting content, you grant Fistpump a royalty-free, perpetual, and worldwide license to use your content as needed to operate the Platform. You agree not to post content that is unlawful, infringes on others’ rights, or violates any agreements.

4. User Conduct

You are responsible for all activities on your account. Inappropriate conduct may lead to account termination. Examples of inappropriate conduct include:

Illegal activities
Harassment or bullying
Tracking or spying on others
Distribution of personal information
Fraud or misleading information
Impersonation
Intellectual property infringement
Spam
Reverse engineering

5. Privacy

Your privacy is important to us. Please see our Privacy Policy for more information. Fistpump may access, preserve, and disclose your information as required by law.

6. Account Termination

You can delete your account at any time by contacting us at help@fistpump.co. Accounts inactive for over six (6) months may be considered abandoned and deleted.

7. SMS Text Messages

Fistpump may send text messages for administrative purposes. To opt out, reply with “STOP.” Standard text messaging rates may apply.

8. Indemnity

You agree to indemnify Fistpump for any losses or liabilities arising from your use of the Platform.

9. Warranty Disclaimer

The Fistpump Platform is provided “as is” without any warranties.

10. Limit of Liability

Fistpump is not liable for any incidental or consequential damages. Our liability is limited to the amount earned from your use of the Platform.

11. Dispute Resolution

Any disputes will be resolved through arbitration, except for small claims or injunctive relief.

12. Governing Law

These Terms are governed by the laws of the State of California.

13. Integration Clause

These Terms constitute the entire agreement between you and Fistpump. If any provision is found to be unenforceable, the remaining provisions will remain in effect.
